Wary of quick statist dismissal of their proposals, cosmopolitans have been careful not to associate themselves with a world state. I argue that this caution is mistaken: cosmopolitans should see the vision of a world state as strategically valuable in exposing weaknesses in statist accounts, particularly of the Rawlsian variety. This strategic value follows if the only cogent arguments against a world state belong to non-ideal theory which assumes non-compliance, rather than to ideal theory with its core (...) assumption of full compliance. If our only convincing reasons to reject a world state are non-ideal, then any liberal theory revolving around separate states must itself be considered a non-ideal theory. As a non-ideal theory, a statist law of peoples cannot be presented as an end-state, but is rather a transitional stage. Yet once seen as a transitional theory, the statist “realistic utopia” can no longer dodge the cosmopolitan charge that it is neither sufficiently realistic nor sufficiently utopian. (shrink)

Genetic resources are a key resource for much biomedical research. Pathogenic genetic resources are of value in the identification, surveillance, understanding, and development of vaccines, treatments, and other responses to major public threats such as pandemic influenza outbreaks. Significant attempts have been made to improve the international governance of infectious disease over the last decade, but the handling of pathogenic genetic resources remains contentious and problematic. The need to address the deficiencies in current arrangements (e.g., the World Health Organization's (...) Pandemic Influenza Preparedness Framework) is urgent because future outbreaks are likely to revert to the past situation in which developed states secured vaccine supplies for their own populations while leaving developing countries vulnerable to the pandemic. Thereby, the collaboration of developed countries with vital international systems such as the Global Influenza Surveillance and Response System is disincentivized. The current international approach to pathogenic genetic resources is based on the sovereign rights of states and access and benefit-sharing arrangements that stem from those rights. While this approach is consistent with international rules on other types of genetic resources, herein I argue that this is an inappropriate approach to pathogens on both political (serving public health goals) and ethical grounds (e.g., equity and justice). Instead I argue for a (modified) common heritage approach to pathogenic genetic resources, based on their intrinsic qualities (e.g., rapid mutation, easy transmissibility) and their value to global efforts to respond to disease outbreaks. I will further argue for de-linking access to these resources from benefit-sharing requirements; explaining that while there are strong justifications for both, their linkage (particularly for pathogenic genetic resources) is problematic and detrimental to the achievement of its intended goals (i.e., ensuring equitable benefit-sharing in return for access being granted). The central subject of Aristotle's ethics is happiness or living well. Most people in his day (as in ours), eager to enjoy life, impressed by worldly success, and fearful of serious loss, believed that happiness depends mainly on fortune in achieving prosperity and avoiding adversity. Aristotle, however, argues that virtuous conduct is the governing factor in living well and attaining happiness. While admitting that neither the blessings not the afflictions of fortune are unimportant, he maintains that the virtuous find life (...) more satisfying than other people do and, with only modest good fortune, they lead happy, enjoyable lives. Combining philological precision with philosophical analysis, the author reconstructs Aristotle's defense of these bold claims. By examining how Aristotle develops his position in response to the prevailing hopes and anxieties of his age, the author shows why Aristotle considers happiness important for ethics and why he thinks it necessary to revise popular and traditional views. Paying close attention throughout to the internalist dimension of Aristotle's approach - his emphasis on how the virtuous view their own lives and actions - the author advances new interpretations of Aristotle's accounts of several major virtues, including temperance, courage, liberality, and 'greatness of soul'. This work sets Aristotle in the broader cultural context of his time, tracing his attemps to accommodate and amend rival views. The author examines literary and historical sources as well as philosophical texts, showing the inherited values and traditional ideals that inform Aristotle's discussions and provide some of the basis for his conclusions. Presupposing no knowledge of Greek or specialized philosophical terminology, the book is designed to be accessible to all students of philosophy or classical antiquity. The COVID-19 pandemic is global and affects all countries in the world. The difference in the financial impact assessment of its outbreak concerns, inter alia, the state of preparation of the public sector in the previous period. The article assumes that countries which coordinated the structure of sovereign assets and liabilities before 2020 were less exposed to the negative effects of financial risks resulting from the COVID-19 pandemic. The study uses data and methodology of the International Monetary Fund (...) and the authors’ measures dedicated to the public sector to assess the sovereign asset and liability management (SALM). As part of the results, the negative value of net worth and the national net welfare index for the studied countries, including Poland in the period before the pandemic crisis, were indicated. In addition, the level of the loans mismatch on the public balance sheet and the scale of the increase in financial risk in the first year of COVID-19 are presented. Conclusions of research make it possible to assess the impact of COVID-19 on Sovereign Asset and Liability Management. (shrink)

This essay combines deconstruction and systems theory to rethink the question of ecological poetics in the work of Wallace Stevens, and in particular some of his most important poems that focus on birds and bird song. Ecocriticism has typically approached literature in general and poetry in particular in terms of its representation of nature. This essay argues for a non-representationalist ecopoetics that derives from replacing the concept of “nature” with the systems theory concept of “environment”. This theoretical shift allows us, (...) in turn, to better understand the relationship of poetry and poetics to the “worlds” in which humans and non-humans live. (shrink)

This article defends state sovereignty as necessary for a form of popular sovereignty capable of realising the republican value of non-domination and argues it remains achievable and normatively warranted in an interconnected world. Many scholars, including certain republicans, contend that the external sovereignty of states can no longer be maintained or justified in such circumstances. Consequently, we must abandon the sovereignty of states and reconceive popular sovereignty on a different basis. Some argue sovereignty must be displaced upwards to a (...) more global state, while others advocate it be vertically and horizontally dispersed to units below, across and above the state. Each group offers a related vision of the European Union to illustrate their proposals. Both these arguments are criticised as more likely to produce than reduce domination because neither can sustain a form of popular sovereignty capable of instantiating relations of non-domination. This article proposes the alternative of a republican association of sovereign states that allows sovereign states and their peoples to mutually regulate their external sovereignty in non-dominating ways. This alternative proposal provides a more plausible and defensible means for sustaining the requisite kind of popular sovereignty in contemporary conditions and a more appropriate vision of the European Union. Sovereign Wealth Funds have attracted significant attention over the past few years, as a result of their increasing role in the global economy and their controversial minority investments in distressed financial and infrastructure companies in Western economies. Although SWFs provide important benefits to home, host and global markets, they have been perceived by the Western mind as a growing threat to economic supremacy and national security. While the current legal scholarship provides an incomplete policy response, by either selectively referring (...) to specific legal instruments within the international law framework or proposing an entirely new legal regime, this Article attempts to address this crucial lacuna by providing an original and comprehensive legal analysis of the SWF phenomenon and its interaction with the preexisting framework of international law. The various abovementioned concerns have prompted various Western attempts to block SWF cross-border investments through legislative reforms or ad hoc protectionism of the executive branch. These governmental policies frequently violate international commitments in the international economic law arena and call for a closer look at the nature of such commitments and their respective implementation in the SWF environment. The Article looks at recent practices in Western countries aimed at blocking SWF investments, especially in the context of iconic brands and national champions. It then reviews various relevant provisions in international legal instruments, which are applicable to these potential investments, and examines the question of their violation by capital-importing countries. A proposed innovative adaptation to this new reality is provided. I argue that the existing framework of international investment law can provide adequate solutions to investment protectionism against SWFs. Regarding regulation of SWFs’ investments, since recent experience has underlined that SWFs function largely like any other commercial entities, there is a need to shift the discussion and terminology towards regulation of sovereign activity rather than sovereign funds. Finally, the Article explores the broad consequences of investment law and corporate governance reforms following the debate around SWF investments on maintaining healthy and productive cross-border economic relations in a globalized world. In the wake of the collapse of the Soviet bloc, it is timely to ask what continuing role, if any, the concept of sovereignty can and should play in the emerging "new world order." The aim of _Law, Power, and the Sovereign State_ is both to counter the argument that the end of the sovereign state is close at hand and to bring scholarship on sovereignty into the post-Cold War era. The study assesses sovereignty as status and (...) as power and examines the issue of what precisely constitutes a sovereign state. In determining how a political entity gains sovereignty, the authors introduce the requirements of de facto independence and de jure independence and explore the ambiguities inherent in each. They also examine the political process by which the international community formally confers sovereign status. Fowler and Bunck trace the continuing tension of the "chunk and basket" theories of sovereignty through the history of international sovereignty disputes and conclude by considering the usefulness of sovereignty as a concept in the future study and conduct of international affairs. They find that, despite frequent predictions of its imminent demise, the concept of sovereignty is alive and well as the twentieth century draws to a close. (shrink)

Following on from The Beast and the Sovereign, Volume I, this book extends Jacques Derrida’s exploration of the connections between animality and sovereignty. In this second year of the seminar, originally presented in 2002–2003 as the last course he would give before his death, Derrida focuses on two markedly different texts: Heidegger’s 1929–1930 course The Fundamental Concepts of Metaphysics, and Daniel Defoe’s Robinson Crusoe. As he moves back and forth between the two works, Derrida pursuesthe relations between solitude, insularity, (...) world, violence, boredom and death as they supposedly affect humans and animals in different ways. Hitherto unnoticed or underappreciated aspects of Robinson Crusoe are brought out in strikingly original readings of questions such as Crusoe’s belief in ghosts, his learning to pray, his parrot Poll, and his reinvention of the wheel. Crusoe’s terror of being buried alive or swallowed alive by beasts or cannibals gives rise to a rich and provocative reflection on death, burial, and cremation, in part provoked by a meditation on the death of Derrida’s friend Maurice Blanchot. Throughout, these readings are juxtaposed with interpretations of Heidegger's concepts of world and finitude to produce a distinctively Derridean account that will continue to surprise his readers. In _Beyond the Sovereign Self_ Grant H. Kester continues the critique of aesthetic autonomy begun in _The Sovereign Self_, showing how socially engaged art provides an alternative aesthetic with greater possibilities for critical practice. Instead of grounding art in its distance from the social, Kester shows how socially engaged art, developed in conjunction with forms of social or political resistance, encourages the creative capacity required for collective political transformation. Among others, Kester analyzes the work of conceptual artist Adrian (...) Piper, experimental practices associated with the escrache tradition in Argentina, and indigenous Canadian artists such as Nadia Myer and Michèle Taïna Audette, showing how socially engaged art catalyzes forms of resistance that operate beyond the institutional art world. From the Americas and Europe to Iran and South Africa, Kester presents a historical genealogy of recent engaged art practices rooted in a deep history of cultural production, beginning with nineteenth-century political struggles and continuing into contemporary anticolonial resistance and other social movements. Derrida's work on hospitality presents particular local conventions of hospitality as in a necessary but impossible relationship with an absolute hospitality, the obligation to welcome the other without conditions. Although this absolute hospitality is commonly read as the aspiration to which all of our practices of hospitality should tend, Derrida proposes a series of examples that show the dangers implicit in an automatic or limitless welcoming. The most famous of these is that of the Old Testament patriarch, Lot. The aim (...) of this paper is to show, however, that the Genesis story is not primarily a parable about correct and incorrect practices of hospitality. In fact, what is at stake in the visit of the angels to Lot is the covenant between Abraham's line and the divine and the coming into the world of God's absolute sovereign violence. Derrida's account of hospitality is thus part of his discussion of sovereignty, its limitlessness, force and danger. (shrink)

Current International Criminal Law (ICL) suffers from at least four fairly serious theoretical shortcomings. First, as a starting point, the concept and meaning of ICL in its different variations must be clarified (‘the concept and meaning issue’). Second, the question of whether and how punitive power can exist at the supranational level without a sovereign (‘the ius puniendi issue’) must be answered in a satisfactory manner. Third, the overall function or purpose of ICL as opposed to national criminal law (...) (‘the overall function issue’) must be more convincingly explained. Fourth, the purposes of punishment in ICL, as opposed to the traditional purposes discussed in national criminal law, must be elaborated (‘the purposes of punishment issue’). There is a partly vertical and partly horizontal relationship between these issues. It is, for example, of course impossible to reflect upon ius puniendi, overall function and purposes of punishment without having clarified the concept of ICL in the first place. Also, a treatment of overall function and purposes of punishment seems to be predicated on the justification of the ius puniendi. Indeed, the lack of a satisfactory answer to the ius puniendi issue is maybe the most important theoretical weakness of current ICL. This article therefore aims to demonstrate that a supranational ius puniendi can be inferred from a combination of the incipient supranationality of the world order (understood normatively as an order of values) and the concept of a world society composed of world citizens whose law—the ‘world citizen law’ (‘Weltbürgerrecht’)—is derived from universal, indivisible and interculturally recognized human rights predicated upon a Kantian concept of human dignity. The incipient world order and the world society are represented by the international community (to be understood as a community of values) which becomes the holder of the ius puniendi. (shrink)

Recent just war thought has tended to prioritize just cause among the moral criteria to be satisfied for resort to armed force, reducing the requirement of sovereign authority to a secondary, supporting role: such authority is to act in response to the establishment of just cause. By contrast, Aquinas and Luther, two benchmark figures in the development of Christian thought on just war, unambiguously gave priority to the requirement of sovereign authority as instituted by God to carry out (...) the responsibilities of ensuring a just and peaceful order in the world. On this conception it is the sovereign, in deciding whether to resort to armed force, who must make sure to satisfy the other moral requirements of the jus ad bellum. This paper examines Aquinas and Luther on sovereign authority for use of armed force. Recapturing the importance of this conception is important both for the proper understanding of just war tradition and for working out its implications for such contemporary issues as humanitarian intervention and "regime change.". Abstractabstract:This article investigates the presentation of state power and affective life in the anime series Yuki Yuna Is a Hero. Juxtaposing the portrayal of the recruitment of female bodies and affects into the defense of the sovereign with the historical context of Imperial Japan, this article elaborates how the series captures the sovereign violence that creates biopolitical subjects in everyday life. It then illustrates how the series appropriates and subverts the genre conventions of the magical girl (mahō shōjo) (...) anime through Giorgio Agamben’s idea of bare life and the state of exception. This subversion offers an opportunity to rethink the politics of disaster in contemporary Japan. Finally, this article probes into the utopian potential of the series by elucidating its affirmation of the relationality of life in an enchanted world. (shrink)

This paper maps superheroes as signifiers of substantive justice and their relationship with the state across two Coverian nomoi, World War II and the “war on terror”. It is argued that the central concern of most superhero narratives is justice, exploring both what it means and how it can best be articulated. This “call to do justice” becomes even more important during wartime where superheroes become agitators for cultural change, appropriating the sovereign decision during states of exception even (...) as they resist co-option by the state itself. Interpreting Nietzsche’s writings on agency and responsibility through the lens of non-sovereignty generates interpretive and political-theoretical contributions. More specifically, I advance three arguments. First, Nietzsche’s genealogical critique of moral responsibility denaturalizes modernity’s conception of individual sovereignty and responsibility, by providing a naturalistic account of agency. Agency and responsibility are neither Kantian presuppositions of practical reason nor pieces of folk psychology to be abolished, but are normative, social, and historical achievements, and thus non-sovereign. Second, this implies a theory of responsibility (...) that is simultaneously more and less demanding than moralistic accounts: while, because agents are not autonomous, they do not bear sole responsibility for their lives, they are called upon to be responsible to and for the world, by maintaining the conditions of possible agency and flourishing. Third, Nietzsche provides both generative resources and cautionary tales for political theories of non-sovereign agency. While non-sovereign responsibility holds emancipatory and potentially democratic implications, Nietzsche’s explicit political writings demonstrate the risk that, rather than tempering existential resentment, this account could generate and intensify a resentful anti-political authoritarianism. Just as non-sovereignty provides a useful framework for making sense of tensions within Nietzsche’s thought, Nietzsche’s post-moral theory of agency and responsibility brings forward tensions, provocations, and paradoxes that must be engaged by theorists of non-sovereignty. When the time comes to decide how to govern an extraterrestrial settlement there will be many alternatives to chose from. We will have the opportunity to try new and so far untested theories, but there are also some old forms of government that might be tempting to try again. We might for instance let the company whose activities on the world are the reason for the establishment govern the settlement. This has been tried before on our own planet both (...) because it was seen as convenient and as an incentive for colonisation. In this chapter I will ask what this solution would mean for the civil liberty of the settlers. To answer the question I will look at some historical analogues and have a philosophical discussion. The conclusion is that a settlement governed by a body whose sole reason for existence is to make money for the owners, that is led by a board that answers only to the owners and not to the people, that functions as both government and sole employer, and that has the unlimited power over the life support systems necessary for the survival of the settlers will not be a good basis for civil liberties.
